"Charting the Juvenile Corrections
Act" - An overview of the act.
JCA Overview - Judge John Varin
The Juvenile Corrections Act of 1995 created a unique
juvenile justice system based on the Balanced Approach/Restorative
Justice Model. This philosophical underpinning guides
a statutory created partnership of the State of Idaho,
through primarily the Idaho Department of Juvenile
Corrections, Counties and the Courts to keep communities
safe, hold juvenile offenders accountable and develop
competency in the youth coming within the purview
of the Act. This session will discuss the provision
of the Act and practices developed to meet the requirements
of the Act.
Alternative Courts - Norma Jaeger
This session will identify the history, status, and
future directions for juvenile drug courts in Idaho.
It will briefly outline the development of juvenile
drug courts as a type of problem solving court and
identify nationally established key elements necessary
for their operations as well as discuss Idaho's Guidelines
for Effectiveness and Evaluation.
Detention - Steve Jett
Juvenile Detention will be discussed as part of the
continuum in the juvenile justice system. Viewing
juvenile detention simply as a place focuses on the
imposing building with razor wire and guards, but
considering it as a process with rehabilitative programs,
well trained officers and educational opportunities
portrays it in a much different way. The evolution
of detention in Idaho, with the accompanying advances
in standards and programs will be discussed. Included
will be a synopsis of national trends and also the
proposed standards for the Prison Rape Elimination
Act, focusing on how Idaho's juvenile detention centers,
correctional facilities and probation departments
may be impacted by them.

Rule 19 - Judge John Varin, Shane Boyle
Idaho Juvenile Rule 19 has been part of the fabric
of Idaho's juvenile justice system for many years.
This rule delineates the discretionary decision points
a juvenile judge must consider before committing a
juvenile offender to Idaho Department of Juvenile
Correction's custody. Recently this Rule was amended
to require screening teams to meet to develop information
on the youth, the youth's family and possible community
programs for the judges to consider at the disposition
hearing. This session will discuss Rule 19 and how
the new provisions are being implemented.
Idaho Code § 20-511A - Ritchie Weers
This session will discuss the process being utilized
to obtain mental health services for juveniles under
I.C. § 20-511A.
Idaho Code § 20-520(1)(i) - Elda Catalano,
Dave McCullough, Shane Boyle
This section will cover the procedure to assist the
criminal justice population obtain substance abuse
assessments and treatment as ordered by the Court,
outline the role of the Judge, probation officer and
the Idaho Department of Health and Welfare (BPA).
Idaho Code § 18-211, 18-212 - Judge John
Vehlow
The competency of juveniles to stand trial is not
addressed by statute or rule in Idaho. However, the
juvenile courts of Idaho are facing this issue with
ever-increasing regularity. The only guidance provided
are the adult competency statutes, I.C. § 18-210,
18-211 and 18-212. The presentation will discuss the
problems inherent in following the adult statute,
as well as explain current proposals regarding draft
language for the development of a juvenile competency
statute.

Idaho's Juvenile Corrections Act and practice under
the Act envisions a broad spectrum of people working
together to address both individual offenders and
system's needs. Each person involved with a case or
a system need brings a different perspective, such
as the ethical obligation of the defense counsel and
who they represent. Blending these perspectives and
the requirements of the Act to enhance both case and
system needs takes understanding beyond our individual
views. This session will discuss how to approach the
differences we have and seek understanding that will
meet offender, victim, community and stakeholder needs
both in a case and for system needs using best practice
principles.
